Should I File a Debt Collection Class Action Lawsuit?

In order to protect consumers against aggressive and abusive debt collectors, there are rules in place which classify certain practices as illegal debt collection methods. These rules are listed and clearly defined in The Fair Debt Collection Practices Act (FDCPA).

Some of the rules highlighted in the FDCPA include banning creditors from using abusive or profane language, making threats of litigation, or contacting consumers at their place of employment after the employer has asked them to stop.

If you recognize any of these tactics, or you suspect that your creditor's similarly harassing methods are in violation of the FDCPA, know that you don't have to sit there and take it, simply because you owe someone money. Just because you are behind on payments doesn't mean you deserve to be verbally abused or harassed at your home or workplace.

If this has happened to you, you may consider filing a debt collection class action lawsuit. In this type of lawsuit you can fight side-by-side with people who have similar complaints about the same company or creditor.

One distinct advantage to a class action lawsuit is that a group of consumers who have been treated illegally will receive a much greater deal of attention than if you were to attempt "going it alone."
In most cases, you won't incur any legal fees unless your Massachusetts class action attorney wins your case. Talk to your attorney about his or her payment structure.
